The applicants’ son died from a gunshot wound inflicted during a scuffle between several men and a police officer. In the circumstances of the case, the use of lethal force by the officer -- intended as a warning shot -- was deemed “absolutely necessary in defence of any person from unlawful violence”. The Court accepted that the use of force that caused the death of Michael Koomen, while extremely unfortunate and tragic, was not a violation of the right to life.
